Beshear needs to do more! He needs to take a camera and sound crew with him and go SEE for himself whether McConnell is alive, incapacitated, or deceased - and do it BEFORE Aug 3rd. You can bet after that date Mitch will be declared dead when his existence is no longer needed to manipulate an election.

Beshear literally cannot do that. Under HIPAA laws, a patient at a medical facility can refuse visitors and the facility cannot disclose info about patients.

Since when have laws applied to politicians? Beshear can claim McConnell is being held against his will by Antifa terrorists, and send National Guard troops to rescue him. The Dems really need to start using their imaginations more.

That's what I've been saying since 30 days ago. It is ridiculous that Beshear has waited this long to do something. I know he's in KY but it isn't that far by plane to DC. If he had made that trip ALREADY he would have been able to hold a special election to REPLACE the DEAD MITCH McConnell

I welcome this, but Beshear needs to call the Republicans' bluff and declare the position vacant and call a special election while he can--before August 3. Let the Republicans take him to court. If he loses, sobeit. But now is the time to fight them.

Unfortunately, Kentucky Governor Andy Beshear cannot unilaterally declare a U.S. Senate seat vacant. Under federal and constitutional rules, a Senate vacancy only occurs if a senator officially dies, resigns, or is formally expelled by a vote of the U.S. Senate itself.

Not really, it is a federal crime to not report the death of a legislator. But, I do think it is better that he's or no other repug is there. He can't vote or interfere.

I do like the idea. Unfortunately, it is not a federal crime under U.S. law to simply fail to report the death of a legislator, as there is no general federal statute criminalizing the failure to report a standard death or a politician's passing.

Are we absolutely sure that law preventing the governor from making an appointment and requiring an election only didn't get overturned in court? I've mentioned that situation to a large group and 3 people said it was overturned.

It has not been overturned. Some people are claiming it violates the Kentucky state constitution but it does not. The state constitution gives the governor the power to fill state and local vacancies, not federal ones.

The sticky point is *proving* the federal vacancy. Perhaps, after the fact ,we can charge people with hiding a corpse to gain a political advantage?

No Individual Declaration: No governor, state lawmaker, or federal leader can unilaterally declare the seat vacant if the senator is incapacitated but still holds the office.

The Special Election Process: Under Kentucky's House Bill 622 passed in 2024, the governor has no power to appoint a temporary replacement. Instead, if a vacancy officially takes place, the governor's sole legal duty is to issue an official proclamation to schedule a statewide special election.

That's why I suggested he show up at the hospital with state troopers and demand to see him, and have anyone preventing him from doing so get arrested.
